Profile

Kazem Elkheir is a founding partner of our firm. Over the past decade, he has built a reputation as the lawyer clients go to when they need someone to engage with the commercial reality of their situation, not just the legal question.

Kazem began his career as a solicitor at Deloitte, where he advised medium to large enterprises and multinational clients, before moving to a leading Sydney commercial law firm to work on complex commercial transactions and litigation. His diverse experience includes representing clients in high profile matters in the Federal Court of Australia, the NSW Supreme Court and District Court of NSW, acting in regulatory proceedings and investigations, obtaining urgent freezing orders and injunctions and negotiating settlements in disputes valued in the tens of millions.

Kazem advises clients across a broad range of industries and has particular depth in the construction, financial services, education and not-for-profit sectors. His practice spans commercial litigation, corporate transactions, insolvency, structuring and dispute resolution.

Kazem is known for providing clear, direct advice, as well as for moving at the pace business demands. Clients describe him as someone who prepares meticulously and thoroughly to examine legal issues from every angle; but also as someone who tells them what they need to hear – even when that’s uncomfortable – and who argues hard on their behalf when it counts.

Kazem holds a Bachelor of Laws (Honours) and a Bachelor of Business majoring in Accounting from the University of Technology Sydney, giving him a combination of legal precision and financial literacy few lawyers can match.

When he’s not working, Kazem enjoys working out, swimming and running. He also a prolific reader.

 

Career highlights

  • Represented an international cryptocurrency investment company in Federal Court proceedings commenced by ASIC (Australian Securities and Investments Commission v NGS Crypto Pty Ltd (No 2))
  • Negotiated settlement in a land development joint venture dispute with an estimated value exceeding $15 million
  • Acted for charities in Supreme Court proceedings against Suncorp Bank (Merciful Group Incorporated v Norfina Limited t/as Suncorp Bank) and Bendigo Bank
  • Obtained various urgent and post-judgment freezing orders in time-critical commercial matters
  • Secured judgment for a client in a contractual dispute including an account for profits and costs (Bachour Enterprises Pty Ltd v Munzer)
  • Successfully set aside dealings including mortgages on property titles
  • Advised a joint venture in relation to a mining project;
  • Advised lessors and lessees across a range of retail and commercial lease disputes
  • Obtained consumer law refunds against motor vehicle dealers in NCAT proceedings (Nikoiee v Marshalls Sydney Pty Ltd)
  • Advised multiple insolvency practitioners on complex administrations, liquidations and asset recovery matters
