FAQs about litigation and disputes lawyers in Sydney

When should I speak to a litigation lawyer?

You should speak to a litigation lawyer as soon as a dispute becomes likely, not just after court proceedings have started. Early legal advice can preserve your contractual rights, improve leverage in any negotiations and even prevent disputes from escalating into expensive litigation.

Many of our clients contact us before issuing a formal claim so that we can help them shape an effective strategy from the outset.

Do all disputes end up in court?

No, most don’t. In fact, litigation should usually be the last resort (although there are some exceptions) and commercial disputes are often best resolved before trial through negotiation, mediation or settlement discussions.

Our role is to assess the strength of your position, identify any points of leverage you might have and recommend the most efficient path to resolution. Where court proceedings are necessary, we’ll prepare matters strategically from day one.

How long does litigation usually take?

Unfortunately, there’s no single answer to this.  Timeframes can vary depending on the complexity of the matter, the court or tribunal involved and the behaviour of the opposing party. Some disputes resolve in weeks. Others can take months or longer.

We provide realistic expectations upfront and work to keep matters moving efficiently wherever possible.

How much does litigation cost?

Costs depend on the scope of the dispute, urgency and procedural complexity. At Elkheir Partners, we provide clear cost estimates and strategic options so clients can make informed decisions about how far to progress a matter.

Where appropriate, we also explore early resolution pathways to reduce your overall legal spend.

Can you help if I need urgent court action or an injunction?

Yes. We regularly act in urgent matters including injunction applications, asset preservation orders and time-critical regulatory or contractual disputes.

If your matter is urgent, we prioritise immediate contact and rapid legal strategy to protect your position.

Do you act for both plaintiffs and defendants?

Yes. We represent clients bringing claims as well as defending proceedings. This includes businesses, directors, senior employees and individuals involved in commercial, regulatory and employment disputes.

Our experience on both sides allows us to anticipate opposing strategies and position matters more effectively.

Will I be dealing directly with a senior lawyer?

Yes – at Elkheir Partners, clients only ever work directly with senior litigators and partners. They don’t get passed through junior lawyers, admin staff or call centres.

This means you always get fast communication, clearer advice and senior strategic oversight.

What courts and tribunals do you appear in?

We regularly appear in the NSW Supreme Court, NSW District Court, Federal Court of Australia, NCAT, the Fair Work Commission, the Administrative Review Tribunal and other specialist tribunals and regulatory forums.

What types of disputes do you handle most often?

Our litigation team regularly handles commercial contract disputes, shareholder disputes, property and construction litigation, regulatory investigations, employment disputes, insolvency litigation and defamation matters.

What should I bring to an initial consultation?

Bring any contracts, correspondence, court documents or regulatory notices you think might be relevant. It’s better to be safe – if we don’t need a document, we’ll let you know during the consultation.

Our focus in the first meeting is to assess risk, clarify options and outline next steps.
