Family and divorce lawyers focused on getting a better outcome for you and your children

Family law disputes are rarely just legal. They usually involve heightened emotions and significant financial decisions, as well long-term parenting arrangements. With so much at stake, the ability to make clear-headed choices under pressure is paramount.

Our family and divorce lawyers understand our clients don’t usually want unnecessary conflict or drawn-out litigation that adds to their stress levels. They want clear advice, sound judgement and a strategy that protects their future, as well as their children’s.

We take a measured, strategic approach to family law matters, focusing on resolving disputes efficiently and cost-effectively, while protecting your interests. That means identifying the real issues early, managing the risk and helping you reach a practical outcome that stands the test of time.

Usually, we try to do this without the time and cost involved in court proceedings. But when litigation is unavoidable, we act decisively and with purpose – always with an awareness of the financial, emotional and reputational cost family law proceedings involve.

Divorce & Family Law services we provide

Our Sydney-based family lawyers advise both individuals and families on issues ranging from separation and divorce through to complex property settlements and parenting disputes. We always focus on providing clear, practical advice that helps you make sound decisions at a stressful time.

Property and financial settlements

Property and financial settlements determine how assets, liabilities and financial resources are divided after a relationship breaks down. This can become complicated when it involves assets like businesses, trusts and superannuation or issues around inheritances and future earning capacity.

Appeals

Family law appeals involve strict time limits and precise technical requirements. That means moving ahead before properly assessing the likelihood of success can lead to severe financial loss. We take the time to carefully assess up front whether a decision is capable of being challenged, as well as the cost and time considerations involved.

Divorce applications

Divorce is the formal legal process that brings a marriage to an end. And, while divorce itself is usually procedural, the timing and sequencing of a divorce application or divorce proceedings can have important consequences for property settlements, financial arrangements and parenting or custody.

Our divorce lawyers are experts at making sure your divorce is handled efficiently, cost-effectively and with minimal stress. We use mediation and other alternative dispute techniques to keep divorce informal, productive and non-confrontational where we can. We also make sure you understand how divorce fits within the broader family law framework, so that you reach the best outcome for yourself and your children.

Experienced family and divorce lawyers based in Sydney

Our team has helped individuals and families from Sydney and around Australia reach better outcomes in divorce and family law proceedings.

Obtaining a freezing order over $10m of assets

Our lawyer proactively investigated our client’s entitlement to a property adjustment order and found that the other party was improperly dealing with the assets of the marriage. We moved swiftly to obtain urgent freezing orders to the value of $10 million to protect our client’s interests.

Obtaining an urgent order that children live with father

In a case involving custody of children, our family lawyers persuaded the court on short notice to discharge previous final orders and issue urgent orders for young children to live with their father. We secured this outcome after issuing subpoenas and obtaining compelling evidence to support our client’s suspicions that the children were at an unacceptable risk of harm if they continued living with their mother.

Obtaining recovery orders for children to return to NSW

In this urgent application, the other parent had relocated interstate taking the children of the relationship with them. Our lawyers successfully obtained orders for the children to NSW and live with our client.

Having freezing orders discharged

Our client’s assets were frozen on short notice, affecting their ability to carry on business. Our family lawyers applied to the court to have the freezing orders discharged, successfully arguing the orders were unnecessary.

FAQs about Family Lawyers

Do I need a family lawyer to get divorced in Sydney?

Not always but getting legal advice is strongly recommended. After all, while the divorce process itself is usually procedural, divorce can affect property settlements, parenting arrangements and financial rights.

Speaking to a family lawyer early helps make sure you’re not overlooking important time limits and strategic considerations.

How is property divided after separation in NSW?

Property isn’t automatically divided 50/50. Instead, the court considers the financial and non-financial contributions of each party, future earning capacity and what outcome is just and equitable in the circumstances. Early legal advice can help clarify likely outcomes and support negotiation before matters escalate.

How are parenting and child custody decisions made?

The court’s primary consideration is the best interests of the child. It will take into account factors such as the child’s safety, the importance of having meaningful relationships with parents and any practical arrangements that support a stable childhood. Most parenting matters are resolved through negotiation or mediation. Litigation is typically a last resort.

How long does a family law property settlement take?

Timeframes vary depending on the complexity of the assets involved, the level of cooperation between former partners and whether court proceedings are required. Straightforward matters can resolve within months, while complex disputes involving businesses or trusts may take longer. Getting strategic legal advice early often shortens the process.

What is spousal maintenance and who is entitled to it?

Spousal maintenance is an ongoing payment made by one former partner to another, where they adequately support themselves and/or their children, and the other has the capacity to contribute. It’s assessed based on financial need and ability to pay. Each situation is different, and entitlement depends on the specific financial circumstances of both parties.

How is child support calculated?

Child support is usually assessed through Services Australia using a statutory formula that considers income, care arrangements and the age of the children. In some cases, parents may enter into private child support agreements. Getting early legal advice can help ensure arrangements are appropriate and enforceable.

Do I have to go to court for family law matters?

No. Most family law disputes resolve through negotiation, mediation or consent orders without a final court hearing. Court proceedings are generally only a last resort where agreement can’t be reached. Taking a measured and strategic approach often reduces the need for litigation.

Can a family law decision be appealed?

Appeals are possible in limited circumstances where a legal or procedural error has occurred. Strict time limits apply and not every unfavourable outcome justifies an appeal. Careful legal assessment is essential before proceeding.

When should I speak to a family lawyer?

It is advisable to seek advice as early as possible after separation. Early guidance can clarify your legal position, protect your rights and reduce the risk of costly or unnecessary disputes later.
